Terms of Service

I. Introduction

These Terms of Service govern Website Privacy Audits and related services ordered through alexproctor.io. References to "I," "me," or "my" in these Terms of Service mean Alex Proctor LLC, a Michigan limited liability company operating as alexproctor.io. By placing an order, you agree to these Terms of Service.

II. The Service

Who You're Hiring

Website Privacy Audits are provided by Alex Proctor LLC and performed personally by Alex Proctor. Although Alex serves as Chief Trust & Privacy Officer at Captain Compliance, audits are conducted independently of Captain Compliance.

What You're Buying

A Website Privacy Audit covers one website and includes three deliverables:

• A recorded video review of your website's observable privacy posture, delivered as a private, shareable link.
• A companion written report covering findings, suggested remediations (where relevant), and estimated risk exposure.
• A live remediation review call of up to 30 minutes, bookable within 30 days of delivery.

Priority orders include the same deliverables on an accelerated timeline, with testing of specific claims cited in a demand letter or legal complaint where you provide them.

Audits are informational and do not constitute legal advice. I am not a law firm and I am not your attorney, and no attorney-client relationship is created by ordering, communicating with me, or receiving deliverables. The audit is not privileged and I make no representation that it is protected work product. If you want the engagement structured through counsel, involve your attorney before ordering. Decisions about how to respond to demand letters, lawsuits, or regulators belong with you and your counsel.

III. Ordering and Delivery

Ordering and Payment

Prices are as listed on alexproctor.io at the time of order. Payment is processed by Stripe, and card details are not processed by this website. Your order form answers, including your consent choices and acknowledgments, are stored with your transaction record.

Your Responsibilities

• You confirm you own the website you submit for audit or are authorized to order an audit.
• You confirm the information you provide at order time is accurate, and that any access details you share are yours to share.
• You will not use the service for unlawful purposes.

I may decline and refund any order at my discretion, including where auditing the website would be unlawful or a conflict of interest.

Delivery Deadlines

Standard audits are delivered within 7 calendar days of payment, and priority audits within 72 hours of payment. If your order is missing information I need (such as a working website URL), the delivery clock starts when I have it, and I'll tell you promptly if that's the case.

If I cannot meet a priority deadline, I'll tell you before starting and offer the choice of an adjusted timeline or a full refund. If I miss your deadline and we cannot agree on a revised delivery, you receive a full refund.

Refunds and Cancellations

Orders are not cancellable and fees are non-refundable, because the value of the service is the expert time itself. I may allow a cancellation or refund in individual cases at my sole discretion. If I fail to deliver your audit, you receive a full refund. Refund questions go to [email protected].

IV. The Deliverables

Your Rights in the Deliverables

Once paid in full, you may use the video and report freely within your business: share them with your team, your counsel, your insurer, your board, and your service providers. You may not publish the deliverables publicly, resell them, or use them in marketing without my written permission.

I retain ownership of my methodology, templates, and know-how. I do not use your deliverables in my own marketing without your written permission.

A Point-in-Time Review

The audit reflects what is observable on your website on the date of review. Websites, third-party scripts, and the law all change, sometimes daily, and the audit does not include ongoing monitoring or updates. A finding of "no issues observed" in an area means just that: nothing observed at that time, not a warranty that no issue exists.

No Guarantees

Every audit reflects my professional judgment and experience, applied carefully to what is observable at the time of review. Even so, I do not warrant that any audit is complete or error-free, and I do not guarantee that following the report will make your website compliant with any law, prevent complaints, demand letters, lawsuits, or regulatory action, or produce any particular business or legal outcome.

V. Your Information

How I handle your information, including what is and is not shared with Captain Compliance, is described in the Privacy Notice. Deliverables are shared through private links intended only for you and the recipients you designate.

VI. Legal Terms

Limitation of Liability

To the fullest extent permitted by law, my total liability arising out of or relating to an order is limited to the amount you paid for that order, and I am not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data. Nothing in these Terms of Service limits liability that cannot be limited by law.

Disputes

These Terms of Service are governed by the laws of the State of Michigan. Before any formal dispute, email me and we'll try to resolve it directly. Most issues are fixable with a conversation. Any dispute that can't be resolved informally will be brought in the courts located in Michigan.

Modifications to These Terms of Service

If these Terms of Service change, the date above changes with them. The terms in effect when you place an order are the ones that apply to that order.

Entire Agreement and Severability

These Terms of Service and the Privacy Notice are the entire agreement between us regarding the Services. If any provision of these Terms of Service is found unenforceable, the rest remain in effect.
